Abstract

American Global Discourse

With his latest book, "Revolutionary Constitutions," Bruce Ackerman returns to one of his earlier writing periods, as he already raised the question of liberal constitutionalism's future in the wake of the collapse of the Soviet Union ("The Future of Liberal Revolution"). In this earlier work, we encounter Ackerman as a political theorist who takes a comparative approach and discusses the constitutionalization of revolution. Later, his research interests became more legalistic, his topics more American, his approach more focused on historical aspects, and his attitude more pessimistic. With "Revolutionary Constitutions", Ackerman now returns to the world stage of comparative constitutional law. The book seeks to answer the fundamental question of how a constitutional order gains and maintains legitimacy. To this end, drawing on Max Weber's typology of legitimate rule, Ackerman distinguishes three historical-cultural pathways through which constitutions have found acceptance. This review introduces Ackerman's trichotomy model, offers both substantive and methodological criticism, and interprets "Revolutionary Constitutions" as the continuation of an intra-American debate by comparative means – and as a study that is illustrative of the "American way" of comparative constitutional law.
