Abstract
To punish the fertilization of a fertilized egg cell
The Bavarian Supreme Regional Court has decided that the thawing of cryo -coched impregnated egg cells in the pre -core stage for the purpose of creating the pregnancy of a woman from whom the egg cell does not come is punishable in accordance with Section 1 (1) No. 2 ESCHG. The court has assumed that such egg cells are not yet fertilized and the thawing of the egg cell, by which the merger of the cell nuclei is triggered, represents fertilization. The article initially highlights the ontology of the egg cell and, in the following, critically deals with the reasons for the decision. In particular, the decision is drawn to the wording of Section 8 (1) ESCHG, which differentiates between the fertilized egg cell and the later core melting. In addition, the lack of discussion of the constitutional conformity of the ban on the egg donation is criticized. The author sees the decision as evidence of the need for reform in reproductive medical law.
