Abstract

The States Duty to Protect Unborn Life and a Woman’s Right to Self-Determination

The debate around the rules and regulations of abortions has hitherto largely focused on the legal and factual preconditions which must be met, and on the procedural rules which must be adhered to before and during the termination, so that a woman may take the decision to have an abortion. A further focus of the debate has been on the legal consequences arising from noncompliance with these substantive and procedural requirements.

If these rules are to respect a woman’s right to self-determination and the states duty to protect unborn life – both of which are a constitutional mandate – they would need to include a compensatory claim of the individual mother against the state. The minimal extent of this claim is directly determined by (the extent of) the states duty to protect unborn life. Through a combined package of material and immaterial assistance, the concrete contents of which must be ascertained on a case-by-case basis, a mother is to be completely indemnified from any short or long term negative financial repercussions stemming from her decision to give birth to her child.
