Abstract

The need for self -defense and insults when killing an unsuspecting attacker

In this article, the decision of the BGH of November 18, 2021 (1 StR 397/21) is presented and critically recognized. In this decision, on the one hand, the BGH addresses the question of the necessity of self -defense in the event of a killing in response to blackmail and comes to the result that the state law enforcement organs have to be contacted primarily as a milder means, even if the self -defense acting should reveal his own criminal preliminary behavior. However, the BGH affirms the presence of a self -defense situation in advance and in this respect a presentation of the attack even after the pronunciation of the threat has been completed as long as this threat is still "works". On the other hand, the BGH continues its jurisprudence, which has already been started in BGHSt 48, 207, to deny the undersolved extortionist even if he did not expect a corresponding reaction of the blackmail. In this respect, the BGH makes a normative restriction because the blackmailer "should have calculated" with such a reaction. Therefore, the perpetrator does not apply to the murder feature of the "insidious" and he can only be punished regularly because of a manslaughter.
