Abstract
The ban on egg donation
Despite the reproductive progress of the recent decades and a changed understanding in society in terms of family design and strengthening women's rights, the legislature adheres to the ban on heterologists. Under the guise of protecting the child's well -being, outdated law remains valid. In the almost unchanged German “Law to protect embryos” (Embryo Protection Act - Eschg) for over 30 years, a preserved legal, medical and scientific zeitge is reflected, but nowadays seems archaic and raises considerable constitutional concerns about the statutory status of the egg donation as an illegal reproduction technology.
