Abstract

Delegated regulation at the EEC level: The insurance industry as an example

In the view of the EEC's liberalization initiative "EC 92", decisions taken by the Commission with regard to the insurance industry are surprising, as they amount to a delegation of important regulatory powers to national insurance associations. This contribution develops a simple model for analyzing the interaction between a regulated industry and a national regulator, serving to explain why the Commission in its turn may prefer to deal with associations rather than governments in this game. Moreover, conditions are determined that may induce the Commission to refrain from imposing unified standards, relying on "competition among regulatory systems" instead. The results are applied to the case of insurance.
