Abstract

Traditional arguments cannot sufficiently justify the German insurance industry's strict regulation and its examption from antitrust law. Competition contributes to the reduction of uncertainty and assures a supply that meets the needs of the insured. The existing limitations to price and product competition provoke substantial welfare losses. The policy targets of a minimum product quality and an improvement of market transparency can be achieved by measures that hardly restrict competition. Antitrust exemption and protection from foreign competition should be abolished.
