Abstract
Bavaria Actually? The Consequences of an Ambiguous American Declaration
In 1945, Ostheim, Sondheim, Stetten and Urspringen, four municipalities of the Rhön region, passed from Thuringian control into Bavarian hands on the initiative of the occupying powers. The transfer went so smoothly that few have since questioned the area’s affiliation with the Free State of Bavaria. This is not merely remarkable in view of the turmoil of occupation and the conflicts triggered by the division of Germany, it also raises the question of whether the factual status quo actually has a sustainable basis in law. Giving an answer requires a clear view of the competences vested in the occupying powers to make territorial adjustments as well as on their exact intentions regarding the four municipalities. It is furthermore necessary to clarify which legal criteria apply to the transfer, as it can be measured against the standards of both constitutional law and public international law.
