Abstract
A Conservative Court
The constitutional law scholars Andreas Kulick and Johann Justus Vasel have presented a study that attests to the fact that the Federal Constitutional Court, at its core, maintains a conservative approach to the constitution (Das konservative Gericht [The Conservative Court], 2021). In doing so, they make a valuable contribution to the difficult and multifaceted topic of how time and constitutional law can be positioned in relation to each other. This review essay, however, critically questions the thesis. Constitutional law is designed from the outset to stabilize a political order and is thus structurally conservative. This is especially true where the constitution is designed to protect a liberal or social order against challenges from both the right and the left. History is not a narrative of progress. Developments in a society and its law cannot be described with scientific precision using political categories such as conservative or progressive.
