Abstract
Administrative Law Figures in Parliamentary Law?
In disputes between members of parliament and presidents of parliaments, the constitutional courts of the federal states of Germany are increasingly using figures that are usually assigned to administrative law, such as the obligation to give reasons and the obligation to be heard. The article analyzes this case law and criticizes it in three respects. Both the legal location of administrative law figures and their application are problematic/debatable. In the process, the courts arrive at results that correspond to a template of administrative law that addresses only the state-citizen relationship. The article concludes that lessons from administrative law in constitutional law must involve a sense of proportion. For parliamentary law, this means that any lessons from administrative law must not contradict the functional logic of parliamentary processes.
