Abstract
Critical rationalism and Kelsen’s Pure Theory of Law come from different fields of science, law and social science/philosophy and are seldom looked at in conjunction with each other. Especially Critical rationalism is not blind to Kelsen’s (and his disciples‘) work and vice versa. Both stand in the tradition of enlightenment and liberalism; both value the force of the better argument and the ideal of an open discourse. Their point is to share skepticism towards political and ideological arguments, which both trains of thought seek to eliminate from scientific discourse. At their conception, these notions were a reaction to the prevalence of ideologies in the first part of the 20th century. Considering that open discourse is under pressure today, it is worthwhile to pay attention to their shared concern, which this paper seeks to do. The article is also a tribute to the philosopher Hans Albert, who died recently at the age of 102.
