Abstract
Thomas Wischmeyer reviews Eberhard Schmidt-Aßmann’s seminal treatise on U.S. administrative law (2021), a book that approaches U.S. administrative law from a distinctly German perspective. Wischmeyer compares and comments on the main themes and discourses in U.S. administrative law and German administrative law, as well as on Schmidt-Aßmann’s account. Further, he demonstrates concern for the state of the U.S. administrative state and the rule of law in the United States, closing on a more pessimistic note than Schmidt-Aßmann. Schmidt-Aßmann’s book and Wischmeyer’s review also contribute to the intense legal (and political) debate, not to say battle in the United States, which engages with traditional German administrative legal thought of the 18th and 19th centuries.
