Abstract

In German criminal jurisprudence, it is disputed whether people who have died can be entitled to legal interests. Only if this is assumed, it is possible to protect the decea‍sed through and from criminal law. The idea of deceased persons being bearers of legal interests is often regarded as a historically outdated notion for which there is no longer room in an enlightened criminal law.

A look at legal history shows that according to older views, the dead were considered capable of acting and having legal capacity. These views are indeed incompatible with the modern conception of death. However, without contradicting this conception, post-mortem protection of personality has developed in German constitutional and civil law for more than 50 years, with the result that rights of the deceased are acknowledged as lasting beyond death. There is no reason to exclude criminal law from this development. Indeed, several criminal law provisions, such as § 189 of the German Penal Code (defamation of the memory of the deceased), protect the legal interests of the deceased. In addition to this protection of the deceased through criminal law, their protection from criminal law, i. e. against certain criminal procedural interventions, is also sensible and necessary.
