Abstract
The remarkable development of biotechnological techniques has brought with it the counterpart that new legal interests may be threatened by certain medical practices. The abuses that can be committed in human cell research have led to the introduction of genetic offences in different legal systems. Based on a theoretical analysis, this contribution shows the need to distinguish between crimes of genetic abuse and genetic manipulation, and places within the latter category the crimes of cloning, genetic alteration and the creation of chimeras and hybrids. The offences of genetic manipulation are presented as result crime, which does not exclude that the specific configuration of this result may vary according to each offence. However, beyond this description, the work presents a criminal-political critique of these criminalization and questions the fact that in many cases we are dealing with a moralization of criminal law.
