Abstract

The relevance that transplant therapies have acquired in the current state of medical disciplines is truly spectacular. One of the main logical consequences of this development is represented by an exponential increase in the demand for human organs to be transplanted. This growing need is not always covered, however, by the availability of transplantable units. In general, health systems present increasingly worrying symptoms of collapse, with increasing difficulties in providing patients in situations of serious impairment to their individual health with vital organs within a medically reasonable period of time. The combination of these factors ends up constituting the inevitable breeding ground for a market, that of illegal organ trafficking, which a sector of the doctrine has described as “infamous trade.” The infamy of the reference phenomenon would have several exceptional protagonists: donors, who, pressured by extreme economic or social circumstances, offer their organs to potential recipients who need them; the recipients, who in many cases conditioned their medical situation, could take advantage of the vulnerability of the organ suppliers; and the State, whose regulatory role in this ceremony of confusion is more discussed than ever. Despite the fact that, given the privileged position of world leadership in organ donation, this case in Spain presents considerably lower numbers than those that characterize other countries, the reform carried out by LO 5/2010, of June 22, incorporated the crime of illegal trafficking of organs into the Spanish Penal Code through art. 156 bis CP. The main objective of the lines that follow is to analyse some problematic aspects of the latest available version of this controversial standard.
