Abstract

Media reports and the results of scientific studies indicate that increasing staff shortages and other organizational deficiencies are not a negligible phenomenon in obstetrics facilities, nursing homes and homes for the elderly. This suggests that the question of criminal liability for organizational deficiencies and resulting personal injuries, which has been discussed more intensively for some time with regard to hospitals, should also be examined in the context discussed here. To this end, in a first step, general principles of organizational responsibility in medical institutions will be elaborated using the example of the hospital, which will then be applied first to the context of nursing homes and homes for the elderly, and subsequently also to the area of obstetrics. For nursing care in particular, it will be necessary to address the tension between care and freedom that must be balanced out, especially in the inpatient nursing setting: on the one hand, there is the staff’s task, assumed upon admission to the facility, of ensuring the protection of the physical integrity of the person to be cared for; on the other hand, there is the obligation to protect the person’s right to self-determination and privacy as far as possible. The difficulty of achieving a balance here must also be considered when outlining the duties of care. At the end of the article, it will become clear that the criminal liability of management bodies for organization-related personal injury in nursing homes and homes for the elderly as well as in obstetrics facilities is subject to certain limitations, but in principle seems possible. Against this background, it would seem advisable for facility managers to pay close attention to the components of quality and risk management and compliance management.
