Abstract
In the 1990s, the German Basic Law was amended to account for the protection of the environment and animal well-being. The Constitution gained an ecological dimension. Furthermore, in 2021, the Federal Constitutional Court introduced the notion of fundamental rights protection for future generations in light of climate change. In her article, Tine Stein evaluates and comments on this ongoing discourse. As a critical, overstating example, she reviews Jens Kersten’s book The Ecological Basic Law (2022). While Kersten argues to soften the procedural character of the Basic Law, Stein warns that an ecological value discourse will be to the detriment of democratic politics. She criticises Kersten for lacking a political perspective and ignoring what is at the core of liberal democracy: the need to persuade a majority.
