Abstract
The recent protest rallies of “the last generation“ have raised the question of possible criminal behavior. They particularly raise the issue of how constitutional norms inform the interpretation and application of lower-ranking law, especially in changing societal circumstances. Leonard Hoeft looks at the constitutionally-friendly and constitutionally-oriented interpretation of § 240 of the German criminal code to make some general points on the subject. He distinguishes between the abstract interpretation of lower-ranking law and its application in order to argue that the constitutionally-friendly/-oriented interpretation is of relevance mostly when it comes to the application of lower-ranking law. When it comes to the abstract interpretation of lower-ranking law, the constitutionally-friendly/-oriented interpretation neither adds clarity nor normative substance, as his paper contends.
