Abstract
This paper explores how judicial independence is affected by the use of artificial intelligence. To this end, Burchardt looks at the factual and legal bases for the use of artificial intelligence in the judiciary, as well as investigating the implications of the use of artificial intelligence for factors that are at the core of (de facto) judicial independence. Furthermore, she examines what this implies, considering the behavior of judges, and additionally, the behavior of others with (undue) influence on judges through their influence on the artificial intelligence system that they use. In addition, the article explores what the use of artificial intelligence in the judiciary entails for public perception of judicial independence. It concludes with remarks on artificial intelligence’s structural impact on the concept of judicial independence.
