Abstract
Japanese legal science has been influenced by German legal science for a long time. In his article, Hajime Konno analyses the life and influence of Toyowo Ōgushi, a Japanese legal scholar who was heavily influenced by Carl Schmitt and Otto Koellreutter. As Konno demonstrates, Ōgushi introduced ideas of National Socialist legal thought into the Japanese legal discourse and argued for nipponism, i.e., the notion that Japan should remain ethnically homogenous. Further, Ōgushi helped to justify Japan‘s war against the United States by theorizing a state of emergency. After 1945, Ōgushi maintained that the imperial constitution remained valid and that the postwar Japanese constitution was unlawful.
