Abstract
The article discusses a ruling by the Social Court of Justice (BSG) from January 2023. The case concerned the (ultimately denied) reimbursement claim of a statutorily insured claimant who had procured a medication herself due to a potentially life-threatening condition of her unborn child. The high requirements set by the BSG for an off-label use, beyond exceptional cases, are criticized. In contrast, it is encouraging (and far more relevant to the current debate on abortion) that the BSG, referencing the jurisprudence of the Federal Constitutional Court (BVerfG) on the re-regulation of abortion from 1993, rejected a “tiered protection concept,” which had recently been promoted by the “Commission on Reproductive Self-Determination and Reproductive Medicine,” despite disregarding constitutional standards.
