Abstract
The argument of antipaternalism provides an intuitively appealing starting point in German constitutional law dogmatics. This intuition underpins the differing constitutional treatment of risks that are statistically identical in their consequences. However, the question arises as to how persuasive this approach truly is when it relies primarily on intuition. This article highlights the argumentative pitfalls of the antipaternalism intuition in light of the coherence of constitutional dogmatics and outlines possibilities for a more emancipatory approach.
