Abstract
This article addresses the multilevel framework of German, European, and international biodiversity protection law as a distinct and innovative legal domain. It provides a comprehensive, coherent and systematic exploration of all relevant issues and developments. The objective is to underscore the broader significance of biodiversity law for the economy, society, and legal scholarship, aiming to elevate it to a “mainstream” subject rather than limiting its relevance to environmental specialists.
The article elucidates the fundamental structures of biodiversity law by critically analysing the legal framework and governance instruments (“Steuerungsinstrumente”). It places particular emphasis on recent legal advancements, including the Global Biodiversity Framework of 2022, the BBNJ Treaty of 2023, and the EU Nature Restoration Law of 2024. The paper addresses the challenges posed by the highly technical and fragmented regulatory landscape, especially concerning the lagging implementation of protective measures.
Finally, the paper engages with current legal discourse on the transferability of the German Federal Constitutional Court’s jurisprudence on intertemporal freedom protection (“intertemporale Freiheitsrechte”) to biodiversity, the need for a codified German Biodiversity Protection Law, and the issue of the Rights of Nature. It advocates for the distinct development of biodiversity law separate from nature conservation law and offers pioneering perspectives for future reforms.
