Abstract

WIEDERGELESEN: Jacques Maritain, "Human rights"

Justin Stagl’s article revisits Jacques Maritain’s reflections on human rights, focusing on Les Droits de l’Homme et la Loi Naturelle (1942). Maritain, once close to the right-wing Action française, broke with it after papal condemnation and developed an integral humanism that reconciled Catholicism with democracy and emphasized human dignity and rights rooted in Thomism.

During WWII he saw the defense of rights as urgent against totalitarianism. His strategy was to seek agreement on rights while setting aside disagreements over their justification. This “bracketing” approach, though indirect, influenced the intellectual climate leading to the UN Declaration of Human Rights in 1948.

Maritain grounded rights in natural law, enriched by Christian revelation, and saw the person as transcendent yet embedded in society. He rejected both individualism and totalitarianism, envisioning a pluralist, personalist society that balanced common good with personal freedom, social justice, and workers’ rights. Stagl finds his wartime style often dogmatic but highlights the lasting value of linking natural law and human rights as a counter to cultural relativism.
