Abstract
To the need to amend postmortal organ transplantation
Organ donation and transplantation is a particularly sensitive and still highly topical issue: the possibility of organ transplantation can save lives or improve the recipient’s quality of life. As long as a sufficient number of organ donations are not available, the issue is, on the one hand, a fair, equal allocation of limited organs while avoiding discrimination and, on the other hand, an increase in the number of donors, which the legislator regularly deals with – currently when considering the introduction of the objection solution and, more recently, the acceptance of non-heart-beating donation in Germany. Here, questions of the right to life in connection with human dignity on the one hand and the right to self-determination, the duty to save lives and the requirements for a fair distribution in accordance with the principle of equality on the other come together. Questions de lege lata concern not only the distribution of organs according to urgency and prospects of success, but also organ-protective treatment steps for patients in the removal hospital before the onset of total brain death, for which the consent of the donor must be obtained. Yvonne Neuefeind deals with these and other questions of organ transplantation in her dissertation, in which she also includes experiences in other countries.
