Abstract
The article examines the restrictive approaches to the offence of murder advocated by Albin Eser in the commentary “Schönke/Schröder” and sets them in relation to efforts displayed in case law to adjust the law with regard to life sentence. Thereby, it demonstrates that the differences are sometimes smaller than one might assume at first glance. His reform proposals de lege ferenda are also already reflected in the current legal situation.
