Abstract

Since 1980, Albin Eser presented and co-authored various proposals for the reform of intentional homicide offenses in German criminal law. Yet, the misguided and outdated formulations on murder and manslaughter introduced in the German Penal Code in 1941 still remain in force. The author, in the spirit of Albin Eser’s writings, presents a reform proposal based on a graduated model of aggravated, „normal“, and mitigated instances of intentional homicide. The distinction between these three degrees of homicide relies on a flexible system of aggravating and mitigating circumstances, which relate to the circumstances of the killing and special conflict situations of the perpetrator.
