Abstract
In exceptional circumstances, a life sentence for murder may not adequately take into account the specific circumstances of the crime. The Oldenburg Regional Court recently had to rule on such a borderline case, in which it was only able to reduce the absolute penalty for murder under Section 21 of the German Criminal Code (StGB) due to a possible reduction in the defendant’s culpability. In light of this decision, the article examines other possibilities for avoiding a life sentence for murder.
