Abstract

Der Beitrag betrachtet die Entwicklung der Rechtsgrundlagen der Fürsorge seit der Gründung der Bundesrepublik Deutschland, insbesondere das BSHG und das SGB XII. Zunächst werden die Entwicklung der Rechtsprechung des Bundesverfassungsgerichts zur Menschenwürde und dann die Entwicklung der Sozialhilfe, die Grundsicherung im Alter, die Grundsicherung bei Erwerbsminderung sowie die Ablösung des BSHG durch das SGB XII dargestellt. Schließlich werden die Bedeutung und die Probleme der Grundsicherung für Arbeitssuchende des SGB II thematisiert. Im Anschluss folgt eine Bewertung einzelner Regelungen.

From Welfare to Social Assistance to Basic Social Security for Those Seeking Work

This paper examines the development of the legal basis of social welfare since the founding of the Federal Republic of Germany. It assess, in particular, the Federal Social Assistance Law (BSHG) and the Social Security Law XII (SGB XII). It begins by analysing the development of legal judgements made by the Federal Constitutional Court on human rights. The evolution of social assistance, state old-age pensions, unemployment benefits as well as the replacement of the BSHG by the SGB XII is then examined. This is followed by a discussion of the importance and the problems of state benefit schemes for the unemployed in the SGB XII. Finally, individual regulations are evaluated.
