Abstract

Abortion – A Political Question?

The Supreme Court’s decision in Dobbs, viewed soberly, merely ends a constitutional imbalance, albeit not by recognizing a right to life for the unborn, but by depriving pregnant women of their presumptive right to abortion, which has existed in practice since 1973. It thus creates political leeway without more detailed constitutional requirements: Every legislative regulation of abortion, its release as well as its restriction, is thereafter equally federally constitutional.
