Abstract
Recently, a legal field called "law of politics" has been added to the sub-disciplines of public law. However, a legal field focused on the politics poses a particular challenge to law: if the logic of law, especially constitutional law, is to unfold, this presupposes a distinction between law and politics. However, this does not preclude law from taking note of the mechanics of political processes. Quite the contrary: if the law and politics are dependent on each other, both gain by taking their respective dynamics and functioning into account, without being overwhelmed by this. A disciplinary approach of "law of politics" therefore offers law the opportunity to take into account its own political logic, to work through interdisciplinary methodological tensions and to develop specific patterns of argumentation. In the interest of distinguishing, rather than separating, law and politics, however, it should not take the place of, but rather stand alongside, established disciplines such as state organisation or organisational constitutional law.
