Abstract
Security checks for MPs? On the constitutional limits of personnel protection
In the Freedom Democratic Constitutional Ordinance of the Basic Law, the state's welfare is assigned to the federal government and the Bundestag. 1 The secret protection is intended to ensure, among other things, that only trustworthy and constitutional people have access to sensitive information. 2 However, security checks that are now used for the 630 parliamentary members 3 are not used to defend constitutional enemies and foreign agents. 4 The following article introduces the instrument of personnel protection and examines the inclusion of elected representatives against the background of current demands.
