Abstract
The transformation of the American administrative state
The American administrative state stands at a crossroads. In Loper Bright v. Raimondo, the U.S. Supreme Court overruled Chevron deference, a foundational doctrine of modern administrative law, thereby shifting interpretive authority from administrative agencies to the judiciary. Loper Bright, however, is not an isolated decision, but an element of a broader anti-administrative turn in the Court’s jurisprudence aimed at constraining the administrative state’s capacity and autonomy. When situated within its historical and political context, this transformation reveals itself as part of a long-term agenda to reshape the state, including through the instrumentalization of the judiciary. The resulting politicization of the courts threatens the rule of law and democratic accountability. While the struggle over administrative legitimacy reflects distinctly American institutional settings and dynamics, these developments offer crucial comparative insights for legal systems worldwide.
