Abstract
Replacement emperor and state notar?
Is the president under the Basic Law merely a "notary" in contrast to the emperor-like president of the Weimar constitution? Or should the Bundespräsident be understood as a functional continuation of the Weimar Reichspräsident? This article revisits the constitutional deliberations in Weimar and Bonn to question the prevailing narrative of rupture between the Weimar Constitution and the Basic Law with regard to their respective presidents. Drawing on detailed analysis of both conventions' protocols, it uncovers significant structural and conceptual continuities between the two offices. In doing so, the study offers a nuanced perspective on the evolution of the German head of state - and challenges long-held assumptions about the distinctiveness of the post-war constitutional order.
