Abstract
The general law "law as science" and "law as an institution"
Taking the doctrine of the generality of the law as an example, this contribution aims to show that nineteenth-century German public law produced a tension—unresolved to this day—between a concept of “law as science” and an understanding of “law as institution”. While “law as science” follows a holistic idea of the unity of law, with the state at its center, “law as institution” emphasizes the rationality of rule-formation arising from the life-forms of society. Remarkably, both conceptions find formal correspondences in different currents of modern natural philosophy.
