Abstract
Parliamentary democracy and German professional civil servants
The study offers a comprehensive constitutional analysis of the institution of the political civil servant (“politische Beamte”) in Germany. Drawing on both legal scholarship and literature from political and administrative science, it highlights the complex interplay between parliamentary democracy and the professional civil service. Tracing the historical and legal development from Prussian constitutionalism to the present day, the work sheds light on the crucial role of political civil servants in the parliamentary democracy that is the Federal Republic of Germany. The article argues that political civil servants are a key mechanism for ensuring effective political leadership within ministerial bureaucracies. Particular attention is then given to recent legal decisions and scholarly trends that seek to limit the scope of political appointments. The study shows the potential effects of these developments on the institution of the political civil servant and criticizes them for the underlying bureaucratic ideal of rationality.
